Privacy Statement
The General Data Protection Regulation (GDPR) is an important law that safeguards the protection of personal data. Through ikwilhuren.nu, MVGM Vastgoedmanagement B.V. (MVGM) collects personal data in the context of the letting of homes and parking spaces. Possibly including yours. We handle this data with care. MVGM attaches great importance to compliance with the GDPR in order to safeguard the privacy of its employees, tenants and other data subjects.
Scope of this Privacy Statement
MVGM respects the privacy and personal life of its website visitors and (prospective) tenants. This privacy statement applies to the processing of personal data via ikwilhuren.nu. For these processing operations, MVGM is the data controller.
Who are we?
MVGM is part of the MVGM group, a leading European property manager and real estate specialist with more than 1,350 employees in 39 offices across 7 countries. Which personal data do we process about you, and how?
MVGM requests as little personal data as possible — only the personal data necessary to properly perform its services. Processing your personal data may be necessary, for example, to provide you with targeted information about our products and services, to enter into and perform agreements, for fraud prevention, to comply with legal obligations, for the use of the website and online services, and to improve our services. Below you can read when and why we need this data, which data we process for this purpose, on which legal basis we process the data, which retention period we apply, where the data is stored, and who may receive this data.

Purpose:
An account is needed to let the right home to the potential candidate and to carry out the appropriate checks in the letting process.
Legal basis:
This processing is necessary for the performance of an agreement between MVGM and the home seeker.
Retention period:
The retention period is 120 days, calculated from the moment you last logged in. After 100 days we send an email “are you still searching?”, after 117 days we send a reminder, and on the 120th day your account and the associated personal data are deleted. You will receive a confirmation email of this.
A home seeker can delete their profile 24/7.

Purpose:
Selecting candidates for a viewing of a rental home based on predetermined, fair and objective allocation criteria. In addition, the data is used to inform prospective tenants about the home and the further letting process.
Legal basis:
Legal obligation (Good Landlordship Act — Wet goed verhuurderschap).
Necessary for the protection of the legitimate interests of:
- The entire group of home seekers;
- The current tenants;
- Local residents;
- The landlords of homes; and
- MVGM.
Retention period:
This personal data is stored in your account. The same retention period applies to this personal data as stated under the heading ‘Creating an account’, namely 120 days from the moment you last logged in.
The viewing requests themselves are retained as long as the home in question has the letting status ‘available’. As soon as the home moves to the status ‘let subject to conditions’, the viewing requests are deleted.

Municipal extract
Purpose:
Allocating a rental home to a candidate who meets the predetermined allocation criteria, including municipal conditions, conditions of the landlord, property criteria and, where relevant, financial capacity. In addition, data is processed for the prevention of terrorist financing, money laundering and fraud, including residency and identity fraud.
Legal basis:
Legal obligation (Good Landlordship Act — Wet goed verhuurderschap).
Necessary for the protection of the legitimate interests of:
- The entire group of home seekers;
- The current tenants;
- Local residents;
- The landlords of homes; and
- MVGM.
Retention period:
For the personal data listed above under “Viewing request”, this personal data is stored in your account. The same retention period applies as stated under the heading ‘Creating an account’, namely 120 days from the moment you last logged in.
The UWV insurance statement, income tax return and/or IB60 form are retained until 90 days after the tenancy agreement has been signed.
In case of rejection, this personal data is deleted after 90 days.

Legally agreeing between the tenant and the landlord on the obligations and rights during the tenancy period, and establishing that the person signing is in fact the tenant.

The legitimate interest of MVGM to bring about the agreement between the landlord and the tenant and to be able to perform its agreement with the landlord.

90 days after the tenancy agreement has been signed.

Legitimate interests
In the table above, for certain (sub)processes — specifically ‘Viewing request’ and ‘Home allocation’ — we state that the processing in question is necessary for the protection of the legitimate interests of the entire group of home seekers, the current tenants, local residents, the landlords of homes, and MVGM. Below, we explain per category which legitimate interests are involved.
The entire group of home seekers. By requesting relevant data prior to the viewing, it becomes clear as early as possible in the letting process whether a home seeker is eligible for the home in question. This prevents home seekers from investing time and effort in a viewing that cannot lead to a tenancy agreement. Moreover, a swift progression of the letting process contributes to shorter vacancy periods, so that homes become available to new tenants more quickly. In a tight housing market, this is crucial.
The current tenants. Viewings constitute an intrusion on the privacy and living enjoyment of current tenants. By selecting upfront for candidates who are actually eligible for the home, the number of viewings is limited as much as possible. MVGM aims to schedule viewings exclusively with candidates who meet the allocation requirements and are therefore realistically eligible for the tenancy agreement.
Local residents. Careful selection based on objective criteria helps ensure that the right tenants are placed in the right homes, which promotes a safe living environment. This is in the interest of all local residents.
The landlords of homes. By collecting, prior to a viewing, the data needed to establish whether a candidate is eligible for the home on the basis of objective criteria, MVGM can organise the letting process carefully and efficiently. This helps ensure that viewings are offered to candidates who genuinely fit the predetermined allocation criteria. This prevents unnecessary delays in the letting process and keeps vacancy periods as short as possible. This is in the interest of landlords.
MVGM. MVGM has an interest in the letting process being carried out carefully, efficiently and in an accountable manner. Collecting data prior to a viewing is required in order to be able to establish whether candidates are eligible for a home. In this way, MVGM can prevent viewings from being scheduled with candidates who do not meet the applicable conditions, and can ensure a fair selection of candidates by means of a draw (lottery). This contributes to consistent execution of the letting process, limits unnecessary delays and reduces the risk that employees are put under pressure or confronted with aggression from disappointed home seekers.
(Security) measures taken
MVGM has taken measures against the following risks in order to safeguard the security of your personal data:
- Protecting personal data against loss and/or damage;
- Physically and through software protecting IT facilities and equipment against access by unauthorised persons, damage and disruptions caused by, for example, hacks, malware infections and viruses. The systems are kept up to date and the protective measures are regularly reviewed by external specialised parties;
- Access to the locations where the personal data is processed is limited to persons who need the personal data for the performance of their duties;
- Application of multi-factor authentication (MFA) to gain access to our systems;
- Ensuring that recovery of personal data in the event of loss and/or damage to the personal data can take place as far and as quickly as possible;
- Destruction of personal data by erasing personal data on hard drives and/or from cloud storage;
- Logging and monitoring with respect to the personal data (such as attempts at unauthorised access to the personal data or disruptions that could lead to corruption or loss of the personal data);
- Providing regular training and awareness for employees;
- Carrying out periodic security audits.
We make sound arrangements with our service providers by means of data processing agreements before we provide the data to them. They are obliged to protect the data using the most up-to-date techniques and may only process it in accordance with our instructions.
Your rights
You have the right of access to your personal data, the right to have your personal data rectified or erased, the right to restriction of processing, the right to data portability, and the right to object to processing. Most of these rights are not absolute and may be subject to exceptions under the law.
Below we set out your rights in more detail and provide information on how you can exercise them. We will respond to your request within one month, but have the right to extend this period by two months if the request is complex or if there are multiple requests. If we extend the response period, we will inform you of this within one month of receiving your request. If your request is manifestly unfounded or excessive, we reserve the right to charge a reasonable fee or to refuse the request in such cases.
- Access: You have the right to ask us whether we process your personal data and, if so, to request access to your personal data. This enables you to receive a copy of the personal data we hold about you and to check whether we are processing it lawfully.
- Rectification: You have the right to request that factually incomplete or inaccurate personal data we hold about you be completed or corrected.
- Erasure: You have the right, in certain circumstances, to request that we delete or erase personal data. There are situations in which we may refuse a request for erasure, for example where the personal data is needed to comply with legal obligations or in connection with legal claims.
- Restriction: You have the right to request that we temporarily suspend the processing of certain personal data, for example if you want us to establish its accuracy or verify the reason for processing.
- Data portability: You may request that a copy of certain personal data be transferred to you or to another party (where technically feasible). You have the right to ask that we provide your personal data to another organisation in an easily readable format. This right applies only to the personal data that you have provided to us yourself and that we process on the basis of your consent or because it is necessary for the performance of the agreement between you and MVGM.
- Objection: Where we process your personal data on the basis of our legitimate interest, you may object to this processing. However, we may be entitled to continue processing your personal data if our legitimate interests override your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims.
In the limited cases where you have given consent for the processing of your personal data for a specific purpose, such as for the use of non-essential cookies or marketing communications, you have the right to withdraw that consent at any time. Please note that withdrawing your consent does not affect the lawfulness of the processing carried out on the basis of your consent before its withdrawal. You can always delete or disable non-essential cookies yourself via your browser settings. You can withdraw your consent to receiving marketing communications via privacy@mvgm.nl.

Right to lodge a complaint with a supervisory authority
If you have a complaint about the way in which we process your personal data, you can lodge a complaint with a supervisory authority in the country where you live, work, or where an alleged infringement of the applicable data protection legislation has taken place. Changes to this privacy statement
MVGM reserves the right to make changes to this privacy statement, for example due to new developments, online services, or in connection with adjustments to (changed) laws and regulations. We will announce these changes on our website. In the event of material changes, account holders will also be informed by email.
